Understanding the New CBD Law in California

After three years of legislation, hemp-derived CBD is officially legal for retail sale in California. Last month, Gov. Gavin Newsom signed AB 45 into law, which removes much of the risk for brands and retailers who sell CBD, but also includes unique requirements for the Golden State. Here’s what you need to know about the new CBD law in California.

New Requirements

Over the coming months, the California Department of Public Health (DPH) will develop detailed regulations around the testing, labeling and marketing of ingestible CBD products. These include food, beverages (non-alcoholic), dietary supplements, cosmetics and pet food. 

Under the new law, CBD product labels must link to third-party test results/a certificate of analysis and include specific warning statements. The new law also prohibits untrue health-related statements and requires that advertisements only be displayed in media where at least 70 percent of the audience is reasonably expected to be 18 or older. 

Additionally, the DPH may impose requirements such as maximum serving sizes and number of servings per container.

Federal Regulations

Although hemp-derived CBD is now legal in California, the Food and Drug Administration (FDA) still considers CBD to be a drug and CBD products to be illegal. This year, the FDA issued warning letters to a number of CBD manufacturers and rejected two new dietary ingredient notifications for full-spectrum CBD extracts, citing insufficient evidence of safety.
