What Is AB 8, in Plain English?

For years, federal law allowed hemp products with no more than 0.3% Delta-9 THC by dry weight. That threshold was written for industrial fiber and grain hemp, not concentrated extracts. Manufacturers found they could infuse a gummy or beverage with several milligrams of Delta-9 THC and still stay under the 0.3% ceiling, simply because the product's total weight diluted the percentage. The result was a fast-growing, largely unregulated category of hemp-derived THC edibles sold in gas stations, smoke shops, and online.

AB 8 closes the Delta-9 THC loophole. The law tightens what can legally go into a hemp-derived food, beverage, or dietary supplement: any hemp extract used in those products must now be CBD or CBN isolate of over 99% purity, with no detectable THC of any kind.
