California's New Hemp THC Law (AB 8): What It Means for Hemp Products & Slumber Customers

If you've noticed hemp-derived THC products disappearing from shelves in California, or you're a Slumber customer wondering why your Deep Zzzs formula is changing, the explanation traces back to one piece of legislation: California Assembly Bill 8 (AB 8).

AB 8 represents one of the most significant regulatory shifts the hemp industry has seen at the state level. Here's what it actually does, why it exists, and what it means if you rely on a hemp-derived product as part of your routine.

For years, federal law allowed hemp products with no more than 0.3% Delta-9 THC by dry weight. That threshold was written for industrial fiber and grain hemp, not concentrated extracts. Manufacturers found they could infuse a gummy or beverage with several milligrams of Delta-9 THC and still stay under the 0.3% ceiling, simply because the product's total weight diluted the percentage. The result was a fast-growing, largely unregulated category of hemp-derived THC edibles sold in gas stations, smoke shops, and online.

AB 8 closes the Delta-9 THC loophole. The law tightens what can legally go into a hemp-derived food, beverage, or dietary supplement: any hemp extract used in those products must now be CBD or CBN isolate of over 99% purity, with no detectable THC of any kind. The law also folds hemp-derived THC products that don't meet this standard into California's existing licensed cannabis framework, meaning they're now regulated (and taxed) the same way a dispensary product would be, rather than sold as an unregulated supplement.

In short: products containing Delta-9 THC derived from hemp can no longer be sold as a dietary supplement in California outside the state's licensed cannabis market. That includes hemp gummies that previously relied on the federal 0.3% threshold to operate.

Lawmakers behind AB 8 pointed to a specific problem: products that looked and were marketed like wellness supplements but delivered a real, sometimes unpredictable, psychoactive dose. Bad actors frequently operated without independent lab testing, consistent potency labeling, or age verification at the point of sale. That stands in contrast to how Slumber has always operated, under the highest standards of compliance for consumer safety.

The legislative intent isn't to eliminate hemp-derived wellness products. CBD isolate and CBN isolate remain explicitly permitted under AB 8, provided they meet the new purity standard. What the law targets is the THC loophole specifically.

If you're a California resident who uses a hemp-derived gummy, tincture, or beverage that contains any amount of Delta-9 THC, you may notice that product becoming unavailable through normal retail or e-commerce channels. Brands operating nationally have had to make a choice: restrict THC-containing products from shipping to California, reformulate a California-specific version using only CBD or CBN isolate, or discontinue operations entirely.
